Engine Build Warranty, Customer Compliance & ACL Statement

This document forms part of the agreement between  Culture Automotive Pty Ltd (“Culture Automotive”, “we”, “us”) and the vehicle owner (“Customer”, “you”). This warranty is provided in addition to your rights under the Australian Consumer Law (ACL) and does not exclude, restrict, or modify any consumer guarantees that cannot lawfully be excluded.

Acceptance of vehicle delivery constitutes acceptance of the terms set out below.



1. Australian Consumer Law Statement (Mandatory)
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to:
-A replacement or refund for a major failure
-Compensation for any other reasonably foreseeable loss or damage
-Repairs or replacement if the goods fail to be of acceptable quality and the failure does not amount to a major failure

Nothing in this warranty limits those rights.

2. Manufacturer’s Warranty (Voluntary Warranty)
In addition to your ACL rights, Culture Automotive provides a conditional manufacturer’s warranty covering the engine build against defects in workmanship and materials for a period of:
Six (6) months or 15,000 kilometers, whichever occurs first,
commencing from the date the Customer takes ownership of the vehicle.

This voluntary warranty is subject to the conditions, limitations, exclusions, and compliance requirements outlined in this document.

3. Conditions of Warranty Coverage
This warranty applies only if:
-The Customer strictly follows the embedment (break-in) procedure
-The vehicle is used solely within the limits of the purchased build package
-All servicing, diagnostics, and repairs are performed by Culture Automotive or an approved third-party provider
-No unauthorized modifications, tuning, or tampering occur

Failure to meet any condition may result in denial of warranty coverage, to the extent permitted by law.

4. Mandatory Embedment (Break-In) Procedure
The embedment process forms part of the engine build itself. Failure to complete it correctly may constitute misuse or abnormal use under ACL.
Stage 1: 0–1,000 km

Conservative driving only

City/suburban use recommended

No aggressive throttle, high RPM, sustained boost, or long freeway driving

Customer obligations:

Regularly inspect and maintain correct oil and coolant levels

Immediately report abnormal noises, leaks, or warning indicators



Stage 2: 1,000–2,000 km

Gradual increase in RPM and boost

No sustained wide-open throttle operation



Stage 3: 2,000 km – Final Dyno Tune

After successful embedment, the vehicle receives its third and final dyno tune.

ECU calibration, data logs, and settings recorded at this stage define the warranty baseline

Any deviation beyond this baseline may void the voluntary warranty



5. ECU, Tuning & Tampering

After the final dyno tune:

Any ECU reflash, recalibration, piggyback tuning, or software alteration voids the voluntary warranty

Removal or disabling of engine safety systems or sensors voids the voluntary warranty

Data logs may be reviewed to assess over-revving, detonation, overheating, oil starvation, or misuse

This does not affect your ACL rights where a failure is proven to be a manufacturing defect.



6. Authorised Repairs & Maintenance

If a fault or concern arises:

The vehicle must be returned to Culture Automotive or an approved service provider

Repairs or diagnostics performed by unauthorised persons may void the voluntary warranty

Emergency repairs must be reported immediately and are subject to review



7. Package Suitability & Intended Use

The Customer acknowledges that engine builds are supplied based on declared motoring goals and selected packages.

Street Package

Intended for normal road use only

Track use, racing, roll racing, drag racing, dyno competition, or any competitive driving constitutes abnormal use

Any failure occurring during or following such use may void the voluntary warranty

Track Package

Intended for non-competitive track days and driver training

Competitive or endurance racing is excluded unless agreed in writing

Race Package

Intended for competition use

Voluntary warranty coverage is limited and applies only to workmanship defects identified prior to competition use, unless otherwise stated in writing

Failures resulting from use outside the intended scope of the selected package are not covered by the voluntary warranty.

8. Warranty Exclusions (To the Extent Permitted by Law)
The voluntary warranty does not cover damage or failure resulting from:

-Abuse, aggressive driving, or abnormal use
-Racing or competition outside the purchased package
-Over-revving, detonation, or lean running conditions
-Oil starvation, oil contamination, or incorrect oil specification
-Coolant loss, overheating, or thermal damage

Fuel contamination or incorrect fuel type

Poor maintenance or failure to monitor fluid levels

External component failure affecting engine operation

Environmental damage (water ingestion, fire, dust, debris)

9. Assessment of Warranty Claims

-Warranty claims may involve inspection, teardown, and review of ECU data logs
-Culture Automotive may require evidence of maintenance and embedment compliance
-Findings will be used to determine whether a failure is due to a defect or excluded cause

Nothing in this process removes your right to seek remedies under ACL.

10. Acknowledgement
By accepting delivery of the vehicle, the Customer acknowledges that they:

-Understand their rights under the Australian Consumer Law
-Understand the limitations of the voluntary warranty
-Confirm the selected package is suitable for their intended use
-Agree to comply with all requirements outlined in this document
